1.What is the importance of the Constitutional Requirements for Pretrial Identification listed for each type of identifying material in your text?

2.Lineups may not be conducted after the prosecution begins unless the suspect waives their rights. However, before the prosecution begins, police can perform lineups almost routinely. Do you believe this is an inconsistent “distinction without a difference”? In other words, do you believe the courts have been overly restrictive in not allowing lineups after the prosecution begins, too lenient on allowing lineups before prosecution begins, or that they have struck the right balance. Explain your thoughts.

1.Explain, in your words, why protection against double jeopardy is not always a good thing. Cite real case examples to support your opinion. Would you change this clause under certain conditions if given the opportunity?

2. Jury venires should be drawn from a representative sample of the community, but should jurors also be selected based on protected class status of the defendant. In other words, must minorities have juries of the same minority group, women have female jurors, etc.?
